Study Klocka Privacy Notice

1. About this Privacy Notice

Study Klocka respects your privacy and is designed to collect only the personal information reasonably needed to provide the service.

This Privacy Notice explains what personal information Study Klocka collects, why we use it, how it may be shared, how long we keep it, and the rights you have in relation to your personal information.

It applies to both the Student and Professional versions of Study Klocka.

Student Mode is intended for users aged 13 and over. If you are under 18, we recommend that you use Study Klocka with the supervision or support of a parent, guardian or responsible adult.

A shorter, easier-to-understand "Your Privacy - Student Guide" explanation is also intended to be provided for Student users.

2. Who We Are

Study Klocka is operated by H Innovators Ltd, United Kingdom.

H Innovators Ltd is the data controller for personal information processed through Study Klocka. This means we are responsible for deciding how and why personal information is processed.

3. Information We Collect

Account information

When an account is created, we may collect:

  • Preferred Name - optional;
  • Email address;
  • Password/account authentication information;
  • Whether the account uses Student or Professional Mode;
  • Email-verification information;
  • Last-login date and time; and
  • IP address used for limited technical purposes, including determining the appropriate timezone or UTC offset.

We do not require your surname, telephone number or date of birth as part of the standard registration process.

Student Mode information

Depending on how Student Mode is configured, we may process:

  • Academic year, semester or term dates;
  • Configured subjects;
  • Study/focus sessions;
  • Focus time and duration;
  • Dates and times associated with study activity; and
  • Activity used to generate your logs, reports and dashboard.

Professional Mode information

Depending on how Professional Mode is configured, we may process:

  • Work periods;
  • Configured projects or tasks;
  • Focus/task sessions;
  • Focus time and duration;
  • Dates and times associated with activity; and
  • Information used to generate your logs, reports and dashboard.

Study Klocka does not currently provide a general facility for uploading documents, photographs, homework, audio, video or other files.

We also do not ask users to provide special-category information such as health or medical information, disability, ethnicity, religion, sexual orientation or political opinions.

4. How We Use Your Information

We use personal information where necessary to provide and operate Study Klocka. This includes:

  • Creating and maintaining your account;
  • Verifying your email address;
  • Authenticating access to your account;
  • Allowing you to configure subjects, projects, tasks or study/work periods;
  • Recording your study, focus or task activity;
  • Calculating and displaying focus time;
  • Generating your dashboard, logs and reports;
  • Allowing you to request that selected logs are emailed;
  • Providing account and technical support;
  • Operating password-reset functions;
  • Maintaining the security and reliability of the service;
  • Determining the appropriate timezone or UTC offset for displaying and processing times;
  • Managing inactive accounts and deletion requests; and
  • Complying with applicable legal and regulatory requirements.

We aim to collect and use only the information necessary for these purposes.

5. Our Lawful Bases for Using Personal Information

Providing the Study Klocka service. We use the personal information necessary to create and manage your account and provide the Study Klocka features you request. For ordinary individual accounts, our principal lawful basis for this processing is performance of our contract with you, which arises when you register for and use Study Klocka under our Terms & Conditions.

Where a Student account is created, configured or purchased by a parent, tutor, school or another organisation, the appropriate lawful basis may depend on the particular processing and relationship. We will apply the lawful basis appropriate to that processing rather than assuming that every activity is based on a contract directly with the Student.

For certain limited purposes, such as maintaining the security, technical operation and reliability of Study Klocka, we may rely on our legitimate interests where appropriate and where those interests are not overridden by the individual's rights and interests. We take particular care where the user is a child.

You do not need to consent to this Privacy Notice. It explains how and why we use your personal information and the lawful bases we rely on.

6. Your Study and Focus Records

Study Klocka records the information needed to provide its study, focus and productivity functions. Your dashboard and reports are generated from your own Study Klocka activity.

Study Klocka does not currently:

  • Score you as a "good" or "poor" student or worker;
  • Categorise you as productive or unproductive;
  • Make grading or eligibility decisions about you;
  • Make significant automated decisions about you;
  • Provide public profiles or leaderboards;
  • Compare your performance publicly with other users; or
  • Use individual study/focus data for behavioural profiling or advertising.

The reports are intended to provide factual information such as focus/study time and subject-, project- or task-related activity.

7. Sharing Your Logs With Someone You Choose

Your Study Klocka information is private by default.

Study Klocka does not automatically send your study/focus reports to parents, teachers, tutors, schools, employers or other people.

You may choose to send selected study/focus logs for a particular period to an email address you specify. For example, a Student user may choose to send a log to a parent or tutor.

Each sharing action must be initiated by the user and requires the destination email address to be entered. This is not recurring or automatic sharing.

The recipient receives the selected log information rather than access to your complete Study Klocka dashboard.

8. Student Accounts Created With Help From a Parent, Tutor or School

In some cases, a parent, tutor or school may initially help create or configure an individual Student account. They may help configure term dates, subjects or initial account details.

They may initially receive or hold the individual account credentials while helping the Student get started. A temporary password may be provided during this process. The Student should change the password when taking control of the account.

Once the password has been changed, the parent, tutor or school does not automatically continue to have access to the account unless the Student provides access.

Purchasing or paying for a Student licence does not, by itself, give a parent, tutor, school or other purchaser a permanent right to access the Student's personal information.

Study Klocka does not currently provide a central parent, tutor or school dashboard for monitoring multiple Students.

In limited supervised-learning situations, a tutor may use an individual Student account with the Student. Where the tutor has authorised access to that account, the tutor may see the information available through that individual account.

9. Children and Student Privacy

Student Mode is intended for users aged 13+.

We recognise that children and young people have their own data-protection rights. We therefore aim to provide Student Mode with a high level of privacy by default and to use children's information only where necessary for the service.

Student Mode currently has:

  • No public profiles;
  • No student-to-student messaging or chat;
  • No follower/friend system;
  • No public leaderboards;
  • No targeted or behavioural advertising;
  • No sale of Student information;
  • No GPS or precise-location tracking;
  • No streaks, points, badges or competitive scores designed to pressure Students to continue studying; and
  • No automatic sharing of study information with parents, tutors or schools.

Students can pause or stop focus sessions and take breaks.

Where a privacy, deactivation or deletion request involving a person under 18 is made by a parent, guardian, school or another person, we may consider the Student's age and understanding, the requester's authority, the Student's views where appropriate, and the Student's best interests rather than automatically treating another person as entitled to control the Student's information.

10. Who We Use to Provide Study Klocka

We use service providers to operate Study Klocka. These currently include:

  • Hostinger - hosting and infrastructure/database services.
  • Google Workspace/Gmail - Study Klocka email communications, Contact Us/support communications and user-requested log emails.

These providers may process personal information on our behalf where necessary to provide their services.

We do not sell or rent your personal information. We also do not commercially provide users' personal information to third parties for advertising.

11. International Processing

Some of the technology providers we use may operate internationally or use infrastructure or support services in different countries.

Where personal information is transferred internationally, we will take appropriate steps required by applicable data-protection law to protect that information.

12. AI, Profiling and Automated Decision-Making

Study Klocka does not currently send users' personal information or study/focus records to ChatGPT, OpenAI or another AI provider.

Study Klocka does not currently use personal information to make significant automated decisions about users.

If we introduce AI processing or materially different personalised analytics involving personal information in the future, we will review the privacy implications, including the Privacy Notice and DPIA as appropriate, before introducing that processing.

13. Cookies, IP Addresses and Timezone

Study Klocka does not currently use personal information for behavioural advertising or advertising tracking.

We use an IP address for limited technical purposes, including deriving the appropriate timezone or UTC offset so that Study Klocka can correctly display and process relevant times.

We do not use GPS to track your precise physical location.

Study Klocka does not currently use advertising or analytics cookies. Any technology strictly necessary for login, security or operation of the service will be used only for those purposes.

14. How Long We Keep Your Information

Active accounts

Account and study/work information is retained while the account remains active and where it is needed to provide Study Klocka.

Inactive accounts

An account that has not been logged into for 12 months may be scheduled for deletion. We intend to send a warning to the registered email address approximately 30 days before scheduled deletion for inactivity. Logging into the account will keep it active.

Support and Contact Us enquiries

Support and Contact Us communications are normally retained for up to 12 months after the enquiry has been resolved, unless there is a legitimate or legal reason to retain them for longer.

Legal and compliance records

After an account is deleted, we may retain limited information where reasonably necessary for legal, compliance or dispute purposes. Such limited records may normally be retained for up to 12 months after account deletion, unless a longer period is required by law or necessary in connection with a legal claim. This does not mean that normal study/work records are routinely retained for this purpose.

Backups

Deleted information may remain temporarily within protected system backups until those backups are overwritten or deleted in accordance with our backup-retention procedures.

15. Account Deactivation and Deletion

Study Klocka currently does not provide a self-service account-deletion button.

You can request deletion of your personal information by contacting info@studyklocka.com or through the Study Klocka Contact Us facility.

We may need to take reasonable steps to verify the request before acting on it.

If a subscription expires but the account is not immediately deleted, the account will remain subject to the normal inactivity and retention rules described above.

16. Keeping Your Information Secure

We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse or disclosure.

Study Klocka uses HTTPS for its website and login service. Users can reset forgotten passwords through the password-reset process. Existing passwords are not available to Study Klocka engineers for retrieval or viewing.

Users are responsible for keeping their login credentials confidential and should not share their passwords with other people except where access is intentionally being provided in an appropriate supervised-use arrangement.

No online service can guarantee absolute security.

17. Your Data-Protection Rights

Depending on the circumstances, UK data-protection law may give you rights in relation to your personal information, including rights to:

  • Be informed about how your information is used;
  • Request access to your personal information;
  • Request correction of inaccurate information;
  • Request deletion of your information;
  • Request restriction of processing;
  • Object to certain processing;
  • Request portability of information in applicable circumstances; and
  • Raise concerns about how your personal information is being used.

These rights are not absolute in every circumstance.

Children have data-protection rights in their own right. We will therefore consider the circumstances carefully where a parent, tutor, school or another person makes a request concerning a Student's information.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data-protection regulator.

19. Changes to This Privacy Notice

We may update this Privacy Notice when Study Klocka changes, when our use of personal information changes, or where legal or regulatory requirements change.

Where a change materially affects how we use personal information, we will provide appropriate information about the change before the new processing begins where required.
